Delaware security deposit law
The state rules a landlord in Delaware has to follow for a residential security deposit, from Del. Code tit. 25, § 5514.
- Maximum deposit
- One month's rent for leases of a year or more, and for month-to-month tenancies after the first year; no cap for shorter leases or furnished units.
- Deadline to return it
- 20 days after the lease ends.
- Itemized deductions
- An itemized list of damages with the estimated repair cost for each, plus payment of the difference, within the 20 days.
- Interest on the deposit
- Not required by state law
- Penalty for wrongful withholding
- Failing to return the deposit or balance in 20 days entitles the tenant to double the amount wrongfully withheld.
Before you keep any part of a deposit
- Compare the unit with the move-in inspection and photos. Normal wear and tear is generally not chargeable.
- Keep receipts or written estimates for every deduction.
- Send the return or the itemized list within the deadline above, to the tenant's forwarding address, and keep proof of mailing.
