Kansas security deposit law
The state rules a landlord in Kansas has to follow for a residential security deposit, from Kan. Stat. Ann. § 58-2550.
- Maximum deposit
- One month's rent for unfurnished units, 1.5 months if furnished, plus half a month's rent more if pets are allowed.
- Deadline to return it
- 14 days after the landlord determines the deductions, and no later than 30 days after the tenancy ends, possession is delivered and the tenant demands it.
- Itemized deductions
- A written notice itemizing accrued rent and damages, delivered to the tenant.
- Interest on the deposit
- Not required by state law
- Penalty for wrongful withholding
- Tenant may recover the amount due plus damages of 1.5 times the amount wrongfully withheld.
Before you keep any part of a deposit
- Compare the unit with the move-in inspection and photos. Normal wear and tear is generally not chargeable.
- Keep receipts or written estimates for every deduction.
- Send the return or the itemized list within the deadline above, to the tenant's forwarding address, and keep proof of mailing.
