Oklahoma security deposit law
The state rules a landlord in Oklahoma has to follow for a residential security deposit, from Okla. Stat. tit. 41, § 115.
- Maximum deposit
- No statutory limit.
- Deadline to return it
- 45 days after the tenancy ends, possession is delivered and the tenant makes a written demand.
- Itemized deductions
- Written itemized statement of deductions, delivered by return-receipt mail or in person.
- Interest on the deposit
- Not required by state law (the balance is returned without interest).
- Penalty for wrongful withholding
- Tenant may recover the deposit and any prepaid rent; no multiplier is stated in the section.
Additional state requirements
Keep the deposit in an escrow account in Oklahoma at a federally insured financial institution. The tenant must make a written demand within six months after termination of the tenancy; without that demand, the deposit reverts to the landlord under § 41-115(B).
Before you keep any part of a deposit
- Compare the unit with the move-in inspection and photos. Normal wear and tear is generally not chargeable.
- Keep receipts or written estimates for every deduction.
- Send the return or the itemized list within the deadline above, to the tenant's forwarding address, and keep proof of mailing.
