Wisconsin security deposit law
The state rules a landlord in Wisconsin has to follow for a residential security deposit, from Wis. Admin. Code ATCP 134.06 (penalty: Wis. Stat. § 100.20(5)).
- Maximum deposit
- No limit in ATCP 134 (prepaid rent over one month is treated as a security deposit).
- Deadline to return it
- 21 days after the tenancy ends (or the date the landlord learns the tenant left, or the new tenant's start date if re-rented sooner).
- Itemized deductions
- Written statement describing each item of damage or claim and the amount withheld for it.
- Interest on the deposit
- Not required by state law.
- Penalty for wrongful withholding
- Tenant who suffers a loss from a violation may recover twice the loss plus costs and attorney fees under § 100.20(5).
Before you keep any part of a deposit
- Compare the unit with the move-in inspection and photos. Normal wear and tear is generally not chargeable.
- Keep receipts or written estimates for every deduction.
- Send the return or the itemized list within the deadline above, to the tenant's forwarding address, and keep proof of mailing.
